Following the strike-out of Barr. Mike Igini (the Akwa Ibom State Resident Electoral Commissioner) from the suit filed by Obong
Nsima Ekere (governorship candidate of the APC), challenging the declaration of Mr. Udom Emmanuel as winner of the March 9, 2019 elections, there are indications that Ekere may change his legal team.
The state Governorship Election Petition Tribunal sitting in Uyo, on Thursday, May 30, had struck out the name of the REC from the suit on grounds that he had no case to answer in the suit.
The Court had questioned the council to the petitioner, Mr. Okutepa (SAN) for joining the State REC in the suit in the first place, when he only functioned as an INEC officer all through the electioneering process, and is already a party in the suit, and not in his personal capacity.
Subsequently, the Council to the petitioner had apologized to the court for wasting its time in the erroneous joining of the State REC in the suit, and thanked the court for its magnanimity in granting the prayers of the 3-4 Respondents who moved the motion to strike out Igini’s name from the suit, describing same as meritorious.
This, our source gathered, did not go down well with the APC guber candidate, Mr. Ekere, having almost lost all of his prayers before the Court.
This may necessitate a change of his legal team in order to keep his chances of winning at the Tribunal bright.
